FCC's McDowell Comments On Merger

US FCC's McDowell says market key to Sirius deal

The proposed merger between Sirius Satellite Radio Inc. (SIRI.O: Quote, Profile , Research) and XM Satellite Radio Holdings Inc. (XMSR.O: Quote, Profile , Research) depends "a lot" on how the market is defined, U.S. Federal Communications Commissioner Robert McDowell said on Thursday.
Sirius, which announced a proposal to buy XM Satellite about two weeks ago, must win approval from the Federal Communications Commission and the Justice Department's antitrust division.
So far, FCC Chairman Kevin Martin has said the deal faces a high hurdle because agency rules currently prohibit one company from holding the only two satellite radio licenses.
